In response to your peers, provide one additional disposition to consider if they had been the judge on the case. Justify your response with course readings. Review the article Teen Gets Probation in Ninja Attack.

First let me say that I never in my life thought I’d read about a case involving someone dressed as a Ninja.

What helped the defendant here was his history of good behavior and his sympathy for the victim. He took ownership of what he did and accepted his punishment. He had no priors and the psychological evaluation determined he was low risk and needs.

I feel the judges decision in this case was fair. I feel if they incarcerated him, it would have made this situation worse. I don’t feel he would have responded well and any goal of helping him improve as a person might have been lost. Putting him on house arrest and probation was the best choice.

If I was the judge in this case I don’t see myself sentencing him in any different way than Rosa did. However, I would have asked why the he was dressed as a ninja in the first place? What was his reasoning for attacking the victim? And why was the victim and others trespassing on private property?

If an adult had done this they would face some jail time. Anywhere from 2-5 years here. All depending on prior behavior. If they had no priors it could be less. As I mentioned in another thread I hope an adult wouldn’t be running around in the woods dressed in a ninja outfit. But, then again we had plenty running around dressed as creepy clowns a few years back. So, nothing would surprise me.

The circumstances that contributed to the chosen disposition option is the boys age, no prior criminal history and already spending two months in a juvenile detention center. I believe the decision was fair. For nearly killing the boy probation, psychological evaluation, continuing to attend school, no possessing a weapon and writing a letter of apology is a whole lot better than serving jail time.

The goals that would have been accomplished by incarcerating the youth would be to make sure it wouldn’t happen again and ensuring the safety of the public.

If I were the judge I would have sentenced him to probation, restitution for the boys medical bills, psychological evaluation, counseling, no contact with the victim or the victims family, letter of apology and no weapons to be possessed. If he had a prior criminal history I would have asked for jail time, probation, restitution, psychological evaluation, mandatory counseling, no weapons and no contact with victim or victims family.

A fair disposition for an adult facing the same situation would be jail time, three years probation, restitution for the medical bills, no contact with victim or victims family, psychological evaluation and no possessing any weapons of any kind. An adult in this situation would be treated a lot harsher then the juvenile. The adult might have gotten charged with a felony assault with a deadly weapon, serve lengthy jail sentenced along with a lengthy probation term. Since the adult might get charged with a felony the adult will not be able to possess or own a firearm or any weapon. Also depending on the judge the adult may also be sentenced to house arrest.
