Negative Gearing

Henry told us in his guide to the Institutional Framework of Taxation in Australia that the Australian Taxation System is one of the most complex in the world and is made up of approximately 125 taxes including taxes such as Income Tax, Capital Gains Tax, Fringe Benefits Tax and Goods and Services Tax just to name a few. He also mentioned that there are many different organisations that play different and varied roles within this system to ensure its integrity and all Australians are equally treated with equity.
The Australian Taxation System is embedded in the way of life for all Australian taxpayers, we pay tax on our income, we pay tax when we purchase goods and use services, we pay tax when we sell assets and this is just to name a few but in return the Government provides services and benefits e.g. hospitals, schools, defence, and financial assistance to those in need etc.
As we know the government relies very heavily on the revenue from taxation to be able to finance its activities and services it offers to the public and reforms on taxation are often a focus of governments. An area of taxation reform that is often under review is the concept of negative gearing. It has been an area of discussion for a while now in Australia, with some arguing it should be abolished and some arguing changes should be made in the way it is used and other demanding that is not affected by any tax reform measures.
So what is Negative Gearing and how does it fit into the Australian Taxation System? ……. Well that is up to you to work out as part of this assessment.
This assessment requires you to review this topical area of taxation (Negative Gearing) which has been playing out in the media for a number of months now as per Part 1 and Part 2 below.

Part One
Review Australian newspapers such as the West Australian, Financial Review, The Australian, Sunday Times and various others for articles on the area mentioned above. You need to find 10 newspaper articles which will be handed in with your assignment. The articles should be from 2016 or 2017 only. If you do not have access to Australian Newspapers then you may use the Factiva Database within the Curtin Library. A factsheet on how to use this database and a short video presentation is included in the assessment link for this assignment on the Blackboard. These newspaper articles must be scanned or saved as PDF files and uploaded to the Blackboard in the appropriate area within the assessment tab. Please Note we will not accept links to the articles.

Part Two
After reading newspapers and looking for the articles on the subject of Negative Gearing and the debate being carried out in the public arena by both political parties, lobby groups and the general public, you should have started to develop your own view on the concept of Negatively Gearing.
For this area of the assessment you need to explain
a) What negative gearing is within an Australian concept
b) What the benefits and disadvantages are of Negative Gearing
c) What is your opinion of negative gearing eg is a good thing or a bad thing, should the government make changes to it or leave it alone, who do you believe benefits from it. This area is based about your opinion so you need to ensure that you give us your own personal views of the topic and not a summary of the articles you have collected in part one of the assessment task.
The requirements of the assignment for part two is to produce a 1000 to 1500 word essay on your opinion of this topic which should be based on your findings from the Australian newspapers you have collected and any other research you may want to undertake, please do not just provide a detailed summary of the articles you have included in Part 1
The word limit does not take into account the cover page or references and we will allow an excess of 10%.

Assignment Submission Process

Please read the submission process carefully. Students should understand that compliance with instructions in relation to an assessment task is critical. Students MUST be aware that non-compliance with these instructions can result in a mark of ZERO.

All assignments must be submitted by 11.59pm (western standard time) on the Monday of the week the assignment is due.

Students will also be required to submit their assignment to Blackboard. The assignment will automatically be submitted to the plagiarism detection programme, Turnitin.

What is Turnitin?

Turnitin is an electronic text matching system that compares text in a student’s assignment against electronic text on the Internet, in published works, on commercial databases, and in assignments previously submitted to Turnitin by students in universities all over the world, including assignments obtained from ‘paper mills’ (Internet sites which sell student papers).

Students and Turnitin

Turnitin is a fantastic resource to assist students with their referencing. Students are given the option to submit a draft assignment into Turnitin (via Blackboard) to retrieve an originality report of their assignment. The originality report is a tool to help locate potential sources of unoriginal work in submitted documents by highlighting similarities between the submitted text and the data in the Turinitin database.

Submitting a draft assignment and reviewing the originality reports provides students with the opportunity to ensure their assignment is referenced appropriately, and to make any necessary changes.

Please note that the similarity percentage that an originality report generates is not a measure of plagiarism, provided students have referenced the relevant primary sources which they obtained their information and ideas from correctly.

Can either or both women suppress the evidence of amphetamine possession from their upcoming trials?

Question
One night Tiffany borrowed a friend’s car so that she and her girlfriend, Heather, could get to their jobs at the hotel where they worked in the cocktail-bar section of the restaurant. In order to be able to stay awake and alert on their shift at the restaurant, the two college women took some amphetamine tablets that they got from their boyfriends at the local law school. While the two women were motoring toward the restaurant, for no valid reason, a police officer stopped the pair just to check them out and inquire where they were going. The officer seemed to have an extra interest in Tiffany, the driver. He decided to search the interior of the car and found the bottle of amphetamine pills in the glove box of the car near where Heather had been sitting. The women explained how the car did not belong to them and that Tiffany had borrowed it from a friend. After their respective arrests, the officers found recreational amounts of marijuana in the purses of both women. Tiffany and Heather are hopeful that all the evidence of drug possession can be excluded from admission in evidence due to a Fourth Amendment violation.

The Procedural Problem

Can either or both women suppress the evidence of amphetamine possession from their upcoming trials? Can they suppress the evidence of marijuana possession? Are both college women in the same legal position? Explain fully, giving proper legal rationales for your decisions.

Question
As an Associate Justice of the U.S. Supreme Court, prepare a 4–5 page opinion for the Court based on the following facts: James Smith was arrested for burglarizing his next door neighbor’s apartment in the state of California. And without the benefit of a warrant, the neighbor, who is a friend of Mr. Smith, forced open the front door to Mr. Smith’s apartment and saw his property. The neighbor called the police, and they immediately arrested Mr. Smith for burglary and possession of stolen property out of fear that he would get rid of the property before they returned with a search warrant. Mr. Smith’s conviction in the state and federal courts were upheld, and it is now before the U.S. Supreme Court. Prepare the Court’s response to this constitutional challenge that Mr. Smith was denied equal protection under the law.

Identify specific examples in the language of prior decisions.
Examine some of the arguments used by the framers of the Constitution while debating the language of the document.
Include any philosophical underpinning that might influence the court’s ruling.
Include any social force(s) that could be useful to guide the decision.
Outline major philosophical arguments of the U.S. Supreme Court in such cases as Weeks v. United States (http://caselaw.lp.findlaw.com/scripts/getcase.pl?court=us&vol=232&invol=383) and Mapp v. Ohio (http://supreme.justia.com/us/367/643/case.html).
Use specific references to support your position from the U.S. Constitution.

Bridgeway Pharmaceuticals manufactures and sells generic over- the -counter medications in plants located throughout hemisphere. One of its plants is trying is trying to decide whether to automate a portion of its packaging process by purchasing an automated waste disposal and recycling machine.
The proposed investment is $400,000 to purchase the necessary equipment and get it into place. The machine will have a five year anticipated life and will be depreciated at a rate of $80,000 per year, toward a zero anticipated salvage value. The firm’s analysts estimate that the purchase of the new waste- handling system will bring annual cost savings of $400,000 from reduced labor costs, $18,000 per year from reduced waste disposal costs, and $200,000 per year from the sale of reclaimed plastic waste net of selling expenses. Bridgeway purchase requires a 20% return from capital investments and faces a 35% tax rate.
A. Using the estimates provided above, Should Bridgeway purchase the new automated waste-handling system?
B. The manager at the plant where the handling system is being contemplated has raised some questions regarding the potential savings from the system. He asked the financial analyst in charge of preparing the proposal to evaluate the impact of the variations in the price of the plastic waste materials, which have proving to be volatile in the past. Specifically, what would be the impact of the price reductions for the waste that drive the revenues from the sales of waste down to half their estimated amounts in years 1 through 5?
C. (Simulation) Model the investment, whose value is determined by the following random variables: Annual revenues from reclaimed waste in year 1 follow a triangular distribution with a minimum value of $100,000, a most likely value $200,000, and a maximum of $300,000. In year 2 (and each year thereafter), the distribution is still triangular; however, the most likely value is now equal to the value observed in the… Attachments: Q..docx
